Negligence: Nija Save Nigeria slams N1bn suit against Kano, FG

The Nija Save Nigeria,  a Non-governmental Organization (NGO) dedicated solely to fight injustice and maltreatment of Nigerians has sued the Kano and the Federal Government for N1 billion for negligence at the Federal High Court, Abuja.

 

In a suit No.FHC/ABJ/CS/722/2018 dated July 10, 2018 , filed on their behalf by their solicitors Messrs. Gordy Uche (SAN)&Co, the plaintiffs made several claims against the defendants jointly and severally

 

The plaintiffs’ claims include: A declaration of the Honourable court that the Executive decision or the administrative actions/inactions of the defendants under the federal highways(building lines) regulation made pursuant to the federal highways Act in allowing the uncompleted/abandoned Toll Gate building at Na’ibawa few meters to Sa’adatu Rimi College of Education on Zaria road, Kano state causing an obstruction, nuisance and constituting a high risk accident to motorists including the plaintiffs, is reckless, wrongful and unlawful.

 

A declaration that the uncompleted/abandoned Toll Gate building erected by the 3rd defendant at Na’ibawa few meters to Sa’adatu Rimi College of Education on Zaria road, Kano, Kano State constitutes an obstruction/accident risk and  was responsible for the motor vehicle crash of the plaintiffs  and the death of Abba Musa Gashash on the 12th day of May, 2018.

 

The plaintiffs also claim the sum of N1billion being damages against the defendants for the motor vehicle crash of the plaintiffs on the 12th day of May, 2018 and the consequent medical expenses and general costs of upkeep of the now disabled plaintiffs.

 

The plaintiffs are also asking the court to compel the 1st, 2nd 3rd defendants to immediately dismantle the said abandoned, dilapidated toll gate at Na’ibawa few meters to Sa’adatu Rimi College of Eduaction on Zaria road, Kano, Kano state.

 

They recalled that the parents of the deceased and the incapacitated petitioned Nija Save Nigeria, who in turn took up the matter and the subsequent suit filed on their behalf.

 

The petitioners alleged that “There is an uncompleted, unpainted, no reflectors, no speed bumps Toll Gate at Na’ibawa, few meters to Sa’adatu Rimi College of Education on Zaria Road. This Toll Gate has claimed many lives of innocent people and will continue to do so on daily basis. One tragic example of a Bus full of women attending a wedding crashed and all but one child died on the spot. So much noise by voiceless Nigerians including Law enforcement Agents, the Nigerian Police, Road Safety, even the Emir of Kano, radio stations & the public has fallen on deaf ears.

 

They noted that the Government of Musa Rabiu Kwankwaso erected the said Toll Gate against advice from many quarters. “This is a federal road I understand which is therefore an illegal structure. The present government under Ganduje has given deaf ears to the cry of the people. On sat 12th May my son Muhammad Hafiz Waziri & two of his childhood friends crashed onto this notorious Toll Gate, one of the victims Ibrahim survived after weeks of treatment at the hospital, the second Abba Musa Gashash went into coma for days & unfortunately died later, the third Muhammad Hafiz Waziri has multiple fractures on both feet and on a wheel chair right now & only Allah can determine if he will walk again and when. There will be no end to accidents at that location until it is demolished to save lives of our people.

 

The purpose of the Nija Save Nigeria platform spearheaded By Barrister Uju Ken Ohannenye is to fight injustice and maltreatment of the Nigerian citizens.

 

Speaking to newsmen after filing the suit, she said cases of injustice, corruption and election malpractice in Nigeria, Police brutality and violence against citizenry including domestic violence, can now be reported for thorough investigations.

 

“You can report illegal government acquisition of citizens properties”, she said adding that “everyone should feel free to post or report cases through videos, audios, text, images privately or publicly, and we will fight for you”.
